中西傳統中的禮儀與法制
在現代之前的中國,約束與調節個人行為的整套規則完全建基在刑法和禮儀體系之上—因而這種體制與體系缺乏合適的民法。現代中國的各種禮儀實踐的持續已經允許斯文(文明)繼續很好地存活下去,但如果這種斯文(文明)想要實現它的所有人文主 義承諾,那麼它就要依賴於制度化法律的種種價值。
Ritual and Law in Chinese and Western Traditions
In pre-modern China, the set of rules that regulated the behaviour of
individuals was singularly based on penal law and a corpus of rites a system thus lacking a proper concept of civil law. The persistence
of ritual practises in modern China has allowed civility to be kept well alive, but this civility has to lean back against the values of institutionalised law if it is to fulfil all its humanistic promises. |

It is generally taken for granted that legal concepts are reflective of cultural attitudes, up to the point that they are believed to enshrine the
DNA of a society. A careful scrutiny of the translation of the Qing Legal Code into English by Sir George Staunton in 1810 clearly demonstrates
that these"peculiar traits of a society" are often more telling of the observers than the observed. |
